The case has been ongoing for over 12 months, after a previous decision to refuse leave to appeal was quashed by the high court.

Leave to appeal against a major expansion of a large company in the region has been rejected.

The decision was published by An Bórd Pleanála in recent days.

Leave to appeal is a process where, if a person has an interest in adjoining land, they can ask the Board to give them permission to make an appeal if 4 specific conditions are met. These 4 conditions include that the conditions approved would change the proposed development, and the impact of the development would affect a person's enjoyment of the land or reduce it's value In this case, leave to appeal was requested by a landowner who owns land adjacent to a planned development at Abbott Ireland located in Cootehill. The case has been ongoing for over 12 months, after a previous decision to refuse leave to appeal was quashed by the high court. Abbott had applied to Monaghan county council to construct an additional warehouse, laboratory and office along with a new bike shelter and 10 car charging spaces. Also included in the application is the change of use of a warehouse to a tower to facilitate ingredient storage and blending as well as the demolition and removal of prefabricated equipment. A third party who declared in interest in adjoining land applied to An Bórd Pleanála for leave to appeal against the development.

In its ruling, the higher planning authority rejected the party's leave to appeal, stating that the conditions set out after permission was granted wouldn't materially change it from the original planned development.
