An attempt to have the verdict in the Kevin Lunney trial adjourned has been rejected.
Senior Counsel for the accused known as YZ had applied for the case to be paused until after an opinion in Graham Dwyer's phone data case is returned later this month.
Michael O'Higgins said that should the Special Criminal Court convict the man, the Court of Justice of the European Union ruling could be relevant and "take years to unpick".
In December of last year the court dismissed a bid to halt the trial over the CJEU case.
Mr Justice Hunt said that the application made yesterday did not do enough to justify an adjournment.
A verdict in the case of the four men charged with false imprisonment and causing serious harm to Mr Lunney is to be handed down on Monday.
